1. Acceptance of Terms
By accessing or using the Elev8 Dance Studio website, booking classes, purchasing packages, or participating in any services, classes, events, or activities offered by Elev8 Dance Studio ( "Studio," "we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms").
If you do not agree to these Terms, you must not use our services.
2. Use of Service
You agree to use our services only for lawful purposes and in accordance with these Terms. You agree not to:
Violate any applicable federal, state, or local laws or regulations
Attempt to gain unauthorized access to any portion of the service
Interfere with or disrupt the service, servers, or networks
Use bots, scraping tools, or automated systems without permission
Impersonate any person or entity or misrepresent your affiliation
We reserve the right to suspend or terminate access for violations.
3. Account Registration
To book classes or access certain features, you must create an account. You agree to:
Provide accurate, current, and complete information
Maintain and promptly update your information
Keep your login credentials secure
Accept responsibility for all activity under your account
Notify us immediately of unauthorized account use
You are responsible for all bookings made through your account.
4. Class Bookings, Passes & Packages
Booking Classes
Classes must be booked through our online platform and are subject to availability and capacity. We reserve the right to modify schedules, instructors, or class formats.
Class Passes & Packages
Class passes and packages include a set number of classes.
All class passes and packages have an expiration date, which will be clearly stated at the time of purchase.
Unused classes expire automatically after the expiration date and are forfeited.
Classes are non-refundable and non-transferable unless explicitly approved in writing by the Studio.
Package pricing and terms may change at any time.
5. Cancellation & Refund Policy
Student Cancellations
Classes must be canceled at least 12 hours before the scheduled start time.
Late cancellations or no-shows will result in the loss of the class credit.
Timely cancellations allow you to rebook another class before your package expires.
Studio Cancellations
If we cancel a class, you will receive a credit or refund for that class only. We are not responsible for additional expenses incurred.
Refund Policy
All sales are final.
All purchases, including single classes, class passes, packages, memberships, and workshops, are non-refundable, with no exceptions, except where required by applicable law.
Unused or expired classes, passes, or packages are forfeited and not eligible for refund or credit.
6. Payments
All payments are processed securely via Stripe. You agree to provide accurate payment information and authorize us to charge your selected payment method.
You are responsible for updating payment details to avoid service disruption.
7. Intellectual Property
All content, branding, logos, choreography (where applicable), website materials, and studio materials are owned by Elev8 Dance Studio and protected by intellectual property laws.
You may not copy, reproduce, distribute, or exploit any content without written permission.
8. Assumption of Risk & Release of Liability (Nevada)
Assumption of Risk
You understand and acknowledge that participation in dance, fitness, and related activities involves inherent risks, including but not limited to muscle strains, sprains, falls, collisions, and other injuries.
You voluntarily assume all risks, known and unknown, associated with participation.
Release & Waiver
To the fullest extent permitted under Nevada law, you release, waive, discharge, and hold harmless Elev8 Dance Studio, its owners, instructors, employees, contractors, and agents from any and all claims, liabilities, damages, injuries, or losses arising from participation, including those caused by ordinary negligence.
This release does not apply to gross negligence or willful misconduct.
9. Indemnification
You agree to defend, indemnify, and hold harmless Elev8 Dance Studio from any claims, damages, losses, liabilities, and expenses (including attorney fees) arising from:
Your participation
Your violation of these Terms
Your actions or omissions while on studio premises or platforms
10. Health & Safety
You represent that you (or your child) are physically able to participate. You agree to:
Disclose relevant medical conditions or injuries
Follow instructor guidance and studio rules
Stop participation if pain or injury occurs
We do not provide medical advice or supervision.
11. Parent / Guardian Consent (Minors)
If the participant is under 18:
A parent or legal guardian must accept these Terms.
The parent/guardian consents to the minor's participation.
The parent/guardian agrees to all waivers, releases, and indemnification provisions on behalf of the minor.
The parent/guardian assumes responsibility for the minor's conduct and compliance.
12. Photo and Video Release
By attending classes, events, or activities at Elev8 Dance Studio, you acknowledge and agree that:
You (or your child) may be photographed, videotaped, or otherwise recorded during classes, rehearsals, events, or while on studio premises.
Elev8 Dance Studio and its authorized representatives have the irrevocable right to use, reproduce, distribute, display, and publish such media for marketing, promotional, educational, and commercial purposes.
Such use may include, but is not limited to:
Social media platforms (Instagram, Facebook, TikTok, etc.)
Studio website and online advertising
Print materials, flyers, and promotional content
Press and media coverage
You waive any right to inspect or approve the final product.
You release Elev8 Dance Studio from any claims arising from the use of such media.
No compensation will be provided.
This consent is perpetual and may not be revoked except as required by law.
If you do not wish to be featured in promotional media, you must notify Elev8 Dance Studio in writing prior to participation. While reasonable efforts will be made to accommodate requests, incidental background appearances cannot be guaranteed.
13. Studio Conduct
We reserve the right to refuse service or remove participants for unsafe, disruptive, or inappropriate behavior without refund.
14. Modifications to Service
We may modify, suspend, or discontinue services at any time. We are not liable for service changes.
15. Governing Law
These Terms are governed by the laws of the State of Nevada, without regard to conflict of law principles.
16. Changes to Terms
We may update these Terms at any time. Continued use constitutes acceptance of the updated Terms.
